General Engagement Terms
The following Engagement Terms apply between the client and myself (the translator). I shall only be bound by other terms and conditions, if they have been expressly acknowledged by me.
1. My translation quotes are subject to confirmation. Jobs and deadlines are only deemed to have been accepted, if they have been expressly confirmed by me.
2. My services cover specialist translation works, diligently executed in accordance with the standards of proper professional practice. Clients receive the contractually agreed copy of the translation. Calculations are based on the price per line or hourly fee agreed with the respective client (taking into account the level of difficulty and the urgency), plus ancillary expenses, disbursements and statutory V.A.T.
The translations are delivered via e-mail, by post or handover. The service is deemed to have been performed upon proper dispatch or delivery.
3. All jobs are treated as strictly confidential by me. I undertake to maintain secrecy about all facts made known to me in connection with work performed for the client. As authorized and sworn translator of documents and deeds, I am by professional ethics, by act of law (§ 189 (4) Courts Constitution Act) and under the BDÜ Code of Conduct bound to the strictest secrecy. This also applies subsequent to job completion and for information made freely accessible to third parties.
4. My right to remedy deficiencies remains reserved. If no opportunity to revise the text is given by the client, compensation for damages will be excluded. Any claims are limited to the net amount of my invoice.
5. I shall only be liable in case of gross negligence or willful intent. Liability is excluded in the event of errors in translations, which are caused by the client due to incorrect or incomplete information or faulty original texts.
6. Translation jobs are governed by German law. The place of performance is my residence or the domicile of my professional office. The place of jurisdiction is the place of performance. The contract language is German.
